On 28th September 2016 Transparency International in Bosnia and Herzegovina (TI BiH) organized a regional conference entitled „Access to Information and Open Data“ on the occasion of the International Right to Know Day. The conference participants tried to make the principles and standards of the proactive transparency, openness and accountability closer to the attendees through the presentation of the research on the implementation of the Law on Free Access to Information in BiH and region and discussions.

Depoliticization as priority of the public administration reform

Centers for Civic Initiatives (CCI) and Transparency International in BiH (TI BiH) welcome basic principles contained within the final version of the Draft Law on Public Service in Canton Sarajevo.
Having in mind extremely negative trends in regard to reforming public service at other levels of BiH, the given Law, although containing several controversial and vague provisions, represents a slight improvement in terms of the professionalization and depoliticization of the public service. In this regard we would like to specifically emphasize the importance of the provisions related to: 1. strict separation of the civil service from the political functions; 2. the selection of the best ranked candidates for the civil service positions, i.e. selection based on the list, and not from the candidate list (which is a request of the Reform agenda); 3. limitation of the term of office of the administrative offices and organizations executives, which shall not be related to the term of office of the organ making the appointment.
We urge the legislators not to violate the aforementioned essential provisions during the adoption of the Law, and to enact the corresponding bylaws after the adoption that will additionally strengthen principles of depoliticization and transparency of employment with the civil service. We particularly emphasize the fact that we will actively monitor drafting of the bylaws (and potential additional amendments to the Law) so to prevent any derogation of the quality and intentions of the provisions of the Law.

Mild disciplinary measures for the civil servants in the Republic of Srpska weaken the institute of disciplinary liability

The amount and duration of fines for the civil servants who conduct severe or mild violation of official duties have been halved by the adoption of the proposal of the Republic of Srpska Government

The National Assembly of the Republic of Srpska has adopted under an urgent procedure the Amendments to the Law on Civil Servants which significantly weakened the existing disciplinary measures for the civil servants. The amount and duration of fines for the civil servants that perform severe or mild violation of official duties have been halved by the adoption of the proposal of the Republic of Srpska Government.

Transparency International in BiH (TI BiH) believes that the institute of the disciplinary liability in the civil service is being additionally weakened in this way. The last amendments adopted in 2011 erased a disciplinary measure which banned the promotion of civil servants who  conducted a severe violation of official duty. The Government continuous the trend of weakening the penal policy by the newly proposed amendments to the civil service laws.

The Government of RS has submitted the proposal under an urgent procedure due to the alleged need to harmonize it with the Law on Labour. At the same time, the adopted amendments are used to make an inconsistent compliance with the labour legislation, introducing different provisions on employment which shall have effect on the violation of the open competition principle.

TI BiH points out that this is only one of many laws adopted under an urgent procedure which is now frequently used by the Government acting as the proponent, specifically in case of important and systemic laws, thus preventing public discussions and timely reaction of the interested public.
