Unlawful employment in Elektroprenos

Upon the request of TI BiH, the Administrative Inspectorate has confirmed that Sanja Radojicic, former Assistant Minister of Finance of RS, was unlawfully hired by Elektroprenos

Banja Luka, 13th January 2017 – Upon the request of Transparency International in Bosnia and Herzegovina (TI BiH) the Administrative Inspectorate has determined that the employment of Sanja Radojicic, former Assistant Minister of Finance of RS, with Elektroprenos was unlawful and it ordered Elektroprenos to correct the irregularities.
In September 2016, through its Advocacy and Legal Advice Center, TI BiH received the information about the unlawful employment of Sanja Radojicic with Elektroprenos. Acting upon this, TI BiH requested from Elektroprenos more details about this employment, after which it was confirmed that the former Assistant Minister of Finance of RS has been the employee of Elektroprenos, on the basis of the Agreement on Takeover/Allocation of Employees signed by Zoran Tegeltija, Minister of Finance of the Republic of Srpska and Mate Zaric, General Manager of Elektroprenos.
After further insistence of TI BiH and filed appeal due to the failure of submitting requested information, Elektroprenos sent to TI BiH the Agreement on the basis of which Sanja Radojicic had been employed, which proves that it was signed contrary to the Law on Labour in Institutions of BiH. Namely, the Law prescribes the possibility of negotiated takeover of employees only between the institutions of BiH, its organs and other legal entities, and therefore cannot be concluded with the entity ministry. After this, TI BiH had submitted to the Administrative Inspectorate a request to perform the inspection supervision, which confirmed the allegations of TI BiH and it ordered to Elektroprenos to eliminate all irregularities related to the employment of Sanja Radojicic within 15 days. TI BiH will continue following this case in order to determine whether Elektroprenos perform the ordered and in which way.
This case represents only a continuation of controversial practice of hiring the RS leading officials’ relatives within Elektroprenos, which is something about TI BiH has already been informing the competent institutions and the public.
