TI BiH filed charges against Nenad Nesic and Dragan Cavic for conflict of interest

TI BiH filed charges due to the conflict of interest against Nenad Nesic, Acting Director of the public company „Putevi Republike Srpske“ and MP in the House of Representatives of the Parliamentary Assembly of BiH, and against Dragan Cavic, Acting Director of the public company „Elektrokrajina“ and MP in the National Assembly of the Republic of Srpska.

Banja Luka, 13th March, 2019 Transparency International in Bosnia and Herzegovina (TI BiH) filed charges against Nenad Nesic and Dragan Cavic to the Commissions deciding on the conflict of interest, for incompatibility of functions of the elected representative and director of public company.

Specifically, Nenad Nesic performs two functions at the same time, Acting Director of the public company „Putevi Republike Srpske“ Ltd. Banja Luka and MP in the House of Representatives of the Parliamentary Assembly of BiH, while Dragan Cavic simultaneously performs functions of Acting Director of the public company „Elektrokrajina“ Banja Luka and of MP in the National Assembly of the Republic of Srpska. The Law on Conflict of Interest in the Government Institutions of Bosnia and Herzegovina, as well as the Law on the Prevention of Conflict of Interest in the Authorities of the Republic of Srpska prescribe the incompatibility of the functions of the director of public company and elected representative at the time of performing the public function and six, i.e.three months after terminating the public function. The charges against Nesic were submitted to the Commission for Deciding on Conflict of Interest, while the charges against Cavic were filed to the Commission for Determining Conflict of Interest in the Authorities of the Republic of Srpska.

Almost a year ago, TI BiH filed a complaint against Dragan Andjelic, due to the violation of the Law on Conflict of Interest in the Government Institutions of BiH,  for being appointed to the position of the Acting Director of ZP „Rudnik i termoelektrana Gacko“ just after resigning from the function of the Deputy Director of the Agency for the Prevention of Corruption and Coordination of  the Fight against Corruption, but there is still no result upon this complaint, considering that the members of the Commission for Deciding on Conflict of Interest from the House of Representatives and the House of Peoples of the Parliamentary Assembly of BiH have not been appointed yet. Therefore, TI BiH urges to establish the Commission as soon as possible in order to start deciding on the current conflict of  interest issues, and it appeals to the Commission of RS to act proactively in cases of incompatibility of functions in order to prevent potential abuses.
