Transparency International in BiH warns that the appointment of the same person to the position of

Parliamentary Military Commissioner of BiH in third mandate would represent the worst violation

of the Law on Parliamentary Military Commissioner of BiH

Sarajevo, 19th February 2018 – Joint Committee on Defence and Security of the Parliamentary Assembly of Bosnia and Herzegovina has submitted to the Parliamentary procedure a proposal to appoint a candidate to the position of the Parliamentary Military Commissioner of BiH, that shall be discussed at the 57th session of the House of Representatives of the PABiH, scheduled for 20th February 2018.

Transparency International in Bosnia and Herzegovina warns that the appointment of the same person to the position of the Parliamentary Military Commissioner of BiH in the third mandate would represent the worst violation of the Law on Parliamentary Military Commissioner of BiH. Namely, the Law on Parliamentary Military Commissioner of BiH clearly indicates that the service of the Parliamentary Military Commissioner of BiH may last up to 5 years, with the possibility of being re-elected, including the fact that the length of service of the first Parliamentary Military Commissioner of BiH had been completed on 30th June 2012.

Having in mind the fact that, as it is pointed out on the website of the Parliamentary Military Commissioner of Bosnia and Herzegovina, the current candidate for this position has already held the position in two mandates, from 16/09/2009 to 27/11/2012 and from 27/11/2012 to 27/11/2017, the appointment of the same person in the third mandate would represent direct violation of the Law on Parliamentary Military Commissioner and absolute ignorance of the prescribed procedures.

TI BiH reminds that the Law on Parliamentary Military Commissioner of BiH prescribes that the role of the Parliamentary Military Commissioner of BiH is to empower the rule of law and protect the human rights and freedoms, and in this case the unlawful appointment would make his role meaningless, and further lead to the lack of public trust into the institutions of Bosnia and Herzegovina.

Transparency International in BiH submitted a request to the Parliamentary Assembly of Bosnia and Herzegovina to provide information on the basis of which the same person has been proposed to be appointed to the position of the Parliamentary Military Commissioner of Bosnia and Herzegovina, considering the restrictive provisions of the given Law.
