TI BiH filed a report against Gordana Tadic

TI BiH submitted a request to the Office of the Disciplinary Counsel to investigate the actions of the Acting Chief Prosecutor Gordana Tadic, pointing out more potential disciplinary violations

Sarajevo, September 11, 2017 – Transparency International in Bosnia and Herzegovina (TI BiH) submitted to the Office of the Disciplinary Counsel a request to investigate the actions of the Acting Chief Prosecutor of BiH, Gordana Tadic, in which it provided several examples of the controversial actions and behaviour of the Acting Chief Prosecutor, contrary to the provisions of the Law on High Judicial and Prosecutorial Council of Bosnia and Herzegovina.
In fact, as announced by the portal Zurnal, the Acting Chief Prosecutor, Gordana Tadic, requested from the Cantonal Prosecutor’s Office of Sarajevo Canton to exclude the case of Josip Simic Djindjic, against whom the mentioned Prosecutor’s Office initiated an investigation due to the criminal offense of „counterfeiting of documents“, although it is a criminal offense defined by the Criminal Code of the Federation of Bosnia and Herzegovina. TI BiH indicated in the information provided to the Office of the Disciplinary Counsel that this pointed out several potential disciplinary violations, such as: interfering with the performance of the judge or Prosecutor with the intention to obstruct or underestimate their activities; engaging in activities which are incompatible with the duties of the Prosecutor; behavior in the court or Prosecutor’s office and outside the court or Prosecutor’s office that harms the reputation of the Prosecutor’s duty or any other behavior that presents serious violation of the official duty or compromises the trust of public in the impartiality and credibility of the Prosecutor’s office.
TI BiH also pointed out the contradictory statements and announcements given by Gordana Tadic in regard to this case as controversial, as well as premature disclosure of not yet investigated information on the alleged monitoring and eavesdropping and the authenticity of documents, which turned not be authentic (or at least the authenticity was not guaranteed at the time of disclosure). The Law on High Judicial and Prosecutorial Council of Bosnia and Herzegovina for which it is reasonably expected to interfere with or harm the fair proceeding or trial, or failing to make the relevant actions that would ensure to make the Prosecutor’s Office employees refrained from giving any comments.
TI BiH emphasized as particularly concerning the announcements of the Acting Chief Prosecutor given at the press conference that the Minister of Security BiH, Dragan Mektic, will be called for a hearing “as a suspect”, due to the previous statements, which means that someone can be prosecuted just for providing his opinion.
TI BiH requested from the Office of the Disciplinary Counsel to act in accordance with its competences and to investigate the provided information, and to inform the public about its actions, having in mind the fact that the statements and behaviour of the Acting Chief Prosecutor arose great interest of public, led to conflicts between institutions in charge of law enforcement and additionally ruined the already low trust of public in judicial institutions.
