Company owned by Zoran Injac concluded a contract with the RS Roads, public enterprise in which Injac is employed

Besides the RS Airports, which awarded a procurement contract to the company owned by Zoran Injac, Chairman of the Supervisory Board of the RS Airports, the public enterprise Roads of the Republic of Srpska, in which Zoran Injac is employed, also awarded a contract to the same company. It is particularly interesting that Zoran Injac was listed in tender documentation related to this procurement as the contact person on behalf of the RS Roads.

Banja Luka, 21st September 2017 – Public enterprise Roads of the Republic of Srpska awarded a contract worth of about BAM 80.000 to the company „WAY2GO“, which was owned by Zoran Injac at the time of the selection of the best bidder, although he is an employee of the RS Roads. The contract was awarded for the „Development of a study and project for the implementation of a system for automatic measurement of maximum weight and axle load of the goods vehicle on the move“, and in this case, just like in the case of the RS Airports, the consortium led by „WAY2GO“ company was the only bidder.
It is especially interesting that Zoran Injac was listed in the tender documentation for this procurement as the contact person of the RS Roads, which placed him in direct conflict of interest situation.
„WAY2GO“ Ltd. Banja Luka, as Transparency International has already pointed out, is a company that has been recently established, and which, so far, has been awarded two contracts as the best bidder by two public enterprises – the RS Airports, a public enterprise in which Zoran Injac is the Chairman of the Supervisory Board, and the RS Roads, a public enterprise in which Zoran Injac is employed. The overall value of those contracts is around BAM 167.000.
TI BiH indicates that the Law on Public Enterprises of RS defines a conflict of interest as a situation when the interest of related persons within an enterprise, including all employees of this enterprise, affects or may affect the interest of the enterprise, and it prescribes that in such case all related persons are obliged to provide the insight into all transactions or relations that may lead to a conflict of interest. The Law strictly prohibits providing more favourable conditions to the employees of the enterprise or persons related to them, and imposes an obligation to all employees to inform the Management and the Supervisory Board in case of having knowledge of the existence of a conflict of interest.
TI BiH submitted a request to the RS Roads to provide information on whether the Supervisory Board and the Management had been aware of all the circumstances of this procurement, and in case they had not, what measures they will take, having in mind the obvious conflict of interest in the procurement implementation.
